1. GENERAL QUESTIONS

1.1. SIA Incity Construction, reg. No. 40203492501, with its registered and legal address at Riga, Skolas iela 22 – 1 (hereinafter – Incity Construction). During the sales process, contracts are concluded with potential buyers and purchasers, and during the contract conclusion process Incity Construction obtains and processes data of natural persons.
1.2. Incity Construction as the controller, when processing personal data, complies with the requirements of the General Data Protection Regulation No 2016/679 of the European Union and the Parliament (hereinafter – the Regulation), as well as other requirements of the laws and regulations in force in Latvia. 1.3. This Privacy Policy explains to customers (hereinafter referred to as “Customers”) how Incity Construction Ltd processes personal data and informs about the processing of personal data by Incity Construction Ltd.

2. THE STAGES AND PURPOSES OF THE PROCESSING OF PERSONAL DATA

2.1. Incity Construction Ltd. collects personal data on the basis of information provided by the buyer (natural person) or its authorised representative about the person with whom the contract and transaction will be concluded, who may be a party to the transaction.
2.2 Incity Construction Ltd processes the personal data of the buyer for the following purposes:
2.2.1. for the purposes of selling the Property and keeping records of potential buyers;
2.2.2. the initiation of the process of concluding the real estate transaction (pre-reservation contract, reservation contract, purchase contract and other contract agreed by the parties);
2.2.3. Preservation of evidence of the transfer of ownership and payment obligations resulting from the sale of the Real Estate;
2.2.4. the performance of obligations and accounting records;
2.2.5. communication with the Purchaser for the execution of the sale transaction, including the correction of non-conformities during the warranty period in the event of a claim;
2.2.6. informing the Buyer (including by sending a notice to the Buyer at the Buyer’s postal address, email and SMS, or contacting the Buyer personally by telephone) of any matters relating to the performance of the Contract.

3. LEGAL GROUNDS FOR PROCESSING PERSONAL DATA

3.1 Incity Construction Ltd processes personal data on the following legal grounds:
Consent of the data subject (buyer, counterparty, authorized person) for the purposes of entering into or performance of the Contract.
3.2 Compliance with a legal obligation established by the laws and regulations of the Republic of Latvia and the EU Ensuring the legitimate interest of Incity Construction Ltd.

4. THE RIGHT TO WITHDRAW THE DATA SUBJECT’S CONSENT

4.1 The data subject has the right to withdraw his or her consent to the processing of his or her data.
4.2 Where a purchaser has expressed a wish to receive information about a property available for purchase, Incity Construction Ltd shall process the name, telephone number and e-mail address of the purchaser only with the data subject’s verbal consent. These data are used until the buyer does not withdraw from receiving offers, but no later than 24 (twenty-four) months, unless the buyer expresses a wish to examine the offer made in more detail after receiving the offers from Incity Construction Ltd.
4.3 If the Buyer has consented to receive advertising, the Buyer may opt-out by sending an email to Incity Construction Ltd.
4.4 Withdrawal of consent shall not affect the processing of data carried out at the time when the buyer’s consent was valid. Withdrawal of consent shall not interrupt the processing of data carried out on the basis of other legal grounds.

5. DURATION OF STORAGE OF PERSONAL DATA

5.1 Incity Construction Ltd shall store personal data in accordance with the defined purposes of processing personal data and the legal grounds for processing personal data as long as at least one of the following criteria exists:
5.1.1 Incity Construction Ltd has a legal obligation to retain the data;
5.1.2. Incity Construction Ltd. needs to exercise its subjective rights established by the regulatory enactments of the Republic of Lithuania;
5.1.3. Incity Construction Ltd. needs to fulfil its contractual obligations;
5.1.4. the data subject’s consent to the processing of personal data is valid.

6. RECIPIENTS OF PERSONAL DATA

6.1 Personal data is not transferred to third countries.
6.2 In connection with the performance of the contract (concluded with the buyer), the employees, processors, subcontractors, business partners, credit institutions, real estate appraisers, as well as the relevant public authorities and officials, such as notary public, land registry, tax and consumer protection authority, may have access to the personal data. Incity Construction Ltd. will respect the confidentiality of the Buyer’s personal data and will disclose personal data to third parties only in cases related to the performance of the Contract, the Reservation Agreement and the Purchase Agreement. Incity Construction Ltd may also outsource services in order to ensure more efficient performance of its functions.

7. THE BUYER’S RIGHT OF ACCESS TO HIS PERSONAL DATA, OTHER DATA SUBJECT RIGHTS

7.1 In order to obtain information about personal data or to exercise other rights of the data subject, the data subject shall, at his or her choice, submit:
7.1.1. a written and signed application, addressed to SIA Incity Construction, actual and legal address Riga, Skolas iela 22 – 1 or, an application signed with a secure electronic signature, addressed to SIA Incity Construction and sent to the e-mail address: [email protected].
7.1.2. Incity Construction Ltd shall communicate with the data subject using the contact details (telephone number, e-mail address, address (the reply will be sent by registered post to the postal address provided in the application)) provided by the data subject. You can also obtain a reply in person at the offices of Incity Construction Ltd (upon presentation of an identity document).
7.1.3 In individual cases, the data subject has the right to request the erasure of personal data, the restriction of the processing of personal data, to object to the processing of personal data, to request the rectification of personal data in accordance with the provisions of the Regulation.

7.1.5 The Purchaser shall have the right to lodge a complaint with the personal data supervisory authority of the Purchaser’s place of residence.

8. PRIVACY POLICY CHANGES

This privacy policy is effective from 19 November 2024. Incity Construction Ltd. has the right to make changes at any time, which are published on the website www.skanstehof.lv.
